Video: Key Dates for NYC and NYS Sexual Harassment Prevention Training

Hi, I’m Jason Klimpl, a partner and an employment attorney at Tannenbaum Helpern, and our firm also serves as general counsel to the New York Staffing Association. Today I wanted to make this quick video concerning the effective dates and deadlines associated with the new New York State and New York City sexual harassment prevention trainings that are now required. So, I have heard from a lot of stakeholders that the New York City training is required by April 1st. That is not the case. April 1st is the effective date of the law that requires annual training. So the annual training under the City would be due by December 31st of this year. Now, who is it due for? It’s due for employees who work at least 80 hours in the City of New York in a given calendar year. Moreover, it’s not due, except for employees who actually work at least 90 days from hire for the employer. Now, what about under state law? State law, which is applicable to all employees, is due by October 9th of this year. Now, employers are encouraged to train employees sooner, under the state harassment law, but when you combine the two, when you combine the city law, which requires training by the end of this calendar year, together with the state law, which requires training by October 9th of this year, that means we ought to be providing training for our covered employees no later than October 9th of this year. So, just to be clear, it is not the case that training is required by April 1st, as I’ve heard from many stakeholders. Of course, employers and staffing firms are encouraged to get prepared for this training, and perhaps to train employees prior to the deadline, such as working with counsel or vendors to prepare yourself.
