Video: Consider these legal issues before posting your next job opening

My name is Marisa Sandler and I’m an associate at Tannenbaum Helpern. Today we are going to be discussing job advertisements. Job advertisements are an important tool for employers seeking to hire qualified candidates. However, employers should be wary of the legal consequences of posting an ill-drafted ad. Federal Civil Rights laws make it illegal for employers to discriminate against employees and applicants on the basis of certain protected classes such as race, age, sex, and religion. States and municipalities often have their own civil rights laws as well, which protect additional classes of people. In New York these laws are the New York State Human Rights Law and the New York City Human Rights Law. A job advertisement which shows a preference towards or against a certain protected class may be viewed as discriminatory and subject an employer to legal liability for unlawful discrimination. For example, a job advertisement which solicits recent college graduates to apply may be viewed as unlawful age discrimination.
