Resolved Wage and Hour Action Against Building Owner and Property Manager Through Mediation

Tannenbaum Helpern’s client, a residential building owner and property manager, faced a federal wage and hour action pursuant to which a former building superintendent alleged, among other things, that the building owner/property manager failed to pay overtime compensation for at least three years. Unfortunately, the client did not have adequate time records for the former super to dispute the allegations, which makes the defense of these actions particularly challenging.

Tannenbaum Helpern employment attorneys conducted interviews of the client and its employees, as well as tenants of the building, and were able to uncover other evidence to help rebut the former super’s claims. Our attorneys prepared a persuasive mediation statement based on such information and negotiated an early settlement on terms acceptable to the client through JAMS mediation, which saved the client significant litigation costs and expenses.
