Resolved claims of discrimination and unpaid commissions

On behalf of a staffing firm, Tannenbaum Helpern resolved an EEOC charge of sex and national origin discrimination, coupled with a claim for unpaid commissions, filed by a former recruiter of the staffing firm. After performing a thorough investigation and comparative analysis of revenue generation among recruiters, the Tannenbaum Helpern team was able to discredit the claimant's wage claims and allegations regarding retaliation making clear his termination was solely a result of performance issues. Through negotiations subsequent to the EEOC mediation process the case was settled for a small fraction of the claimant's initial demand thereby avoiding litigation.
