Obtained Injunction Against Competitor’s Misrepresentation of Status as Authorized Distributor

Tannenbaum Helpern successfully obtained injunctive relief for an authorized United States distributor of trademarked high-end hardware systems for curtains and window treatments and its European supplier, preventing a competitor from misrepresenting that it is an authorized distributor of the trademarked products. The defendant competitor, for several years, misrepresented on its website and in its advertising that it was an authorized distributor of our clients' products and displayed the clients' trademark in a manner that fostered the misrepresentation. The competitor intransigently ignored numerous oral and written demands to stop the misconduct.

Tannenbaum Helpern successfully resolved the matter cost-effectively by filing and aggressively pursuing an action under the Lanham Act for misrepresentation and false advertising and related claims and negotiating a settlement that included entry of a consent injunction enjoining the defendant from any further misrepresentation of authorized distributor status.
