Tannenbaum Helpern’s employment attorneys digested client correspondence, financial documentation and other records to craft a response to a Department of Labor inquiry regarding the failure of the company to give the full 90 days’ prior written notice of the business’s shutdown and resulting loss of employment by all employees. They successfully asserted the faltering company exception to NY WARN requirements and enabled the client to avoid a full audit and investigation of the underling circumstances of the business closure and related corporate actions.
