Video: New York Paid Family Leave

Hi I’m Andrew Yacyshyn, employment attorney at Tannenbaum Helpern, and welcome to our HRMinute. Today I’d like to briefly discuss the new New York State Paid Family Leave law, which goes into effect on January 1, 2018. Under this law, employers will be required to provide eligible employees with paid leave benefits to attend to certain family responsibilities, such as the birth of a child, or to care for a family member with a serious health condition. Employers will need to obtain new insurance policies to cover these benefits, however the policy premiums will be paid for by the employees themselves through payroll deductions. Notably, this leave is job protected. Meaning employers cannot retaliate against employees for taking this leave, and employees must be restored to their job positions, or a comparable position, upon returning to work. The state has recently proposed rules to help clarify many of the provisions of this law, so employers should be on the lookout for the adoption of these rules. Thank you.
