Stopped infringement of client’s design patent by a foreign firm

Our client learned that several foreign companies it had collaborated with in producing a product based on the client's patented design were collaborating with each other in importing a competitive product with a confusingly similar design. We commenced a Section 337 Proceeding before the International Trade Commission to obtain an exclusion order barring the importation of the product. After the government sided with several of our positions concerning infringement, the case was settled on the eve of trial on a basis satisfactory to our client.

THSH's selection of a proceeding before the ITC rather than a federal court lawsuit got results for the client significantly more quickly and cost-effectively than a court proceeding would have.
