Our client learned that another firm was operating in its industry under a very similar trade name and service mark. When negotiations failed we sued in federal court and moved for a preliminary injunction. The injunction was granted after a hearing, which led to a favorable settlement under which the defendant ceased using the infringing service mark and made a significant payment to our client.
