Established Applicability of Healthcare Licensure Exemption
Client's provision of staffing services consisting of licensed professionals was challenged by New York State as requiring a home health agency license. We were able to find an exemption for the client's services in the licensure law and obtain confirmation of its applicability from the New York State Department of Health's Division of Legal Affairs. The factors leading to a successful outcome were the technical expertise, regulatory knowledge and experience of the Tannenbaum Helpern attorneys.
