Biography

Paul Sarkozi is Chair of Tannenbaum Helpern's Litigation and Dispute Resolution practice and a member of the firm’s Management Committee. Recognized by Super Lawyers in the New York Times since 2012 as one of the Top 100 Lawyers in the New York Metro area, Paul is a savvy litigator and negotiator who focuses on results for his clients. Equally adept in federal and state court, Paul has nonetheless developed a particularly strong reputation in New York's Commercial Division, the branch of the NY Court system that handles complex business disputes.

Paul is regularly selected by his peers and the judiciary to serve in leadership positions involving commercial litigation in New York. Chief Judge Jonathan Lippman selected Paul to serve on the Statewide Commercial Division Advisory Council. Chief Judge Janet DiFiore appointed Paul to her Statewide Alternative Dispute Resolution Advisory Committee, for which he serves as Chair of the Commercial Subcommittee. Paul also recently served as Chair of the State Bar's Commercial and Federal Litigation Section, which regularly addresses critical issue affecting business litigation in both NY State and Federal courts.

A versatile advocate, Paul is called on by business entities and senior executives in a broad range of industries to counsel them on the best ways to prosecute, defend and resolve their disputes. He has represented hedge funds, private equity firms, broker-dealers real estate developers, global media and public relations firms, clothing designers and importers, international technology companies and even foreign country. Paul has handled disputes involving complex commercial contracts, trade secrets, restrictive covenants, business breakups, enforceability of arbitration awards and claims of breach of fiduciary duty, unfair competition, trademark and copyright infringement, fraud and veil piercing.

Paul has recently been called upon to advise and represent companies pursuing and protecting investments in the evolving cannabis and CBD oil industries. To that end, Paul serves as a member of the NYSBA Cannabis Law Committee.

Finally, Paul is an experienced, smart and effective negotiator. His knowledge and skill in this area have been recognized by Columbia Law School, where he has been appointed a Lecturer-in-Law to teach a Negotiation seminar. Paul also serves on the roster of mediators for the Commercial Division in New York County.

  • Successfully represented a broker dealer in obtaining injunctive relief against competitor and former employees to enforce restrictive covenants and to protect trade secrets under the Defend Trade Secrets Act.
  • Successfully represented private equity fund in multi-jurisdictional dispute (federal and state court in two states) with management of portfolio company concerning rights under operating agreement and to enforce restrictive covenants.
  • Successfully represented hedge fund to enforce conversion rights in securities dispute with issuer over the proper conversion ratio.
  • Successfully represented records management company in prosecuting and defending numerous breach of contract, tortious interference and restrictive covenant claims in multiple state and federal jurisdictions.
  • Successfully defended beverage manufacturer in dispute with competitor over claims of false advertising and unfair competition and prosecuted claims of breach of contract and breach of warranty.
  • Successfully represented real estate developer in New York Commercial Division business breakup trial against co-developer.
  • Successfully represented trustee in multi-jurisdictional estate litigation.
  • Successfully defended seller of commercial real estate against claims of breach of contract, fraudulent inducement and fraudulent concealment.
  • Successfully represented public relations company in pursuing claims for damages for breach of non-solicitation agreement.
  • Obtained dismissal of claims predicated on veil piercing against investors in real estate dispute.
  • Advised foreign country on dispute with hedge funds concerning debt obligations.
  • Successfully defended airplane lessor against claims of damages arising from termination of contract with international consulting and advisory company.
