As the economic outlook continues to remain "uncertain", many office and retail tenants are conflicted about long-term space commitments. Tenants may negotiate accelerated exit and/or expansion rights in order to address the unpredictability of their future space needs, which may include rights of assignment and subletting, rights of first refusal and rights of first order. Landlords cannot ignore the needs of tenants for such space flexibility if they plan to be competitive in the leasing market. However, landlords need to protect themselves against the adverse consequences of granting such rights.
