The board should do all they can to reach organizational goals, but members still have a responsibility to follow the organization’s rules.

The negotiation of construction management agreements can be a long, arduous and costly struggle unless key business and legal terms are resolved before the owner’s first draft of the agreement is presented to the construction manager for comment. In this program, experienced construction attorneys will offer, from the owner’s perspective, a drafting and negotiation process designed to cut down on an excessive exchange of redlines before the final agreement is reached. The key issues in a typical CMA will be presented and suggestions offered for resolution.

Independent Contractors | What You Need to Know About the New Rule

The misclassification of employees as independent contractors has long been the basis for many class action wage & hour lawsuits as well as governmental audits. Most recently in the news, gig companies - who have been enjoying a beneficial relationship with their workers being classified as independent contractors - have experienced a string of misclassification law suits.
In October, the Department of Labor proposed a new rule regarding the misclassification where it creates a lower standard for employee classification. and some of the proposed legislation includes a more holistic look at the worker's employment. Historically, investment managers, particularly emerging managers, have assumed that in order to have a successful fundraise and to meet their Rule 206 regulatory requirements, they would need to spend large sums building out a complete in-house back-office consisting of a Chief Financial Officer, Chief Operating Officer, Trader, and Chief Compliance Officer. However, a dramatic shift in the preferences of institutional investors is taking place. Enter outsourcing. Institutional investors have begun recommending, and in some cases mandating, investment managers outsource key functions of their back-office and trading to build proper independent controls around critical infrastructure (i.e. cash movements, regulatory compliance, etc.). Outsourcing these functions to independent third parties allows managers to minimize risks, minimize operating costs, streamline operations, and create a more institutional quality offering and of course, meet their regulatory needs.

On April 6th, 2016, staffing attorney Joel A. Klarreich spoke at The Future of Work Summit, presented by the Brooklyn Chamber of Commerce's Workforce Development Committee, in partnership with LiquidTalent.
