Assessing the Default and Termination of a Construction Manager

On April 17, 2024 from 12-1pm, Tannenbaum Helpern Construction & Design members, Kenneth Block and Hillel Sussman, along with Julie C. Geden from Zubatkin Owner Representation, will be presenting a webinar on construction manager defaults and termination.

Program Description: Defaulting a construction manager is a drastic remedy which should be used only in the event the problems on a project are insurmountable. This program will examine the circumstances in which the remedy may be advisable and detail the steps an owner should consider before and after taking action. Topics will include:

  • Reasons for the default of a CM
  • Steps which may be taken to avoid default
  • Assessing the advisability of the remedy
  • Effectuating the termination

This event has been approved for 1.0 New York State CLE credits in the category of Areas of Professional Practice. The credits are both transitional and non-transitional; this program is suitable for both experienced and newly admitted attorneys. There is no fee to attend this program.

Agreements to Access Adjacent Properties During Construction

On May 1, 2024 from 3-4pm, Tannenbaum Helpern Construction & Design partners, Melissa Billig and Brandon Reiner, will be presenting a PLI webinar on considerations that need to be made when building on land with neighboring properties.

Program Description: When building on land bordered by neighboring properties, developers must protect such properties as required by the local Building Code. This program will explore common protections for adjacent properties and discuss key terms to be included in license agreements to permit these protections - from both the developer and adjacent owner perspectives. Legal remedies available to developers in the event a neighbor does not cooperate with the implementation of the required protections will also be presented. Topics will include:

  • Strategy for initial discussions with the developer and adjacent owner, sensitivity points and pre-negotiation escrow
  • Types of protections and addressing sensitivities associated with the protections
  • Key contractual terms (i.e. license fee, professional fees, escrow, insurance, indemnity, etc.)
  • Discussion of seeking court-ordered access (i.e. RPAPL Section 881) and timing
