For U.S. patents filed before 2013, such as the patent at issue in this case, the patent belongs to the first to invent, not the first to file an application. Here, Searle challenged Merck's patent on Vioxx claiming that it, Searle, was the first to invent the drug. By using compelling documentary evidence and testimony from the Merck inventors, we were able to prove that Merck was in fact the first to invent.
