Heralded as "the first cannon shot of the biotechnology era", Ortho v. Becton Dickenson Co. involved the Kung et al monoclonal antibody patents. The case presented two novel problems. First, it presented a new and emerging technology which few people were aware of. Second, the law on biotechnology was only developing. We were successful because our witnesses and experts were able to explain the technology in a clear, straightforward manner and we presented the case adhering as closely as possible to relevant case law in the pharmaceutical field.
