Our client, a generic pharmaceutical company in India, was interested in purchasing an American generic pharmaceutical company. We performed a due diligence review, not only reviewing the American company's IP but also IP owned by others which the American company might be infringing. This review included present as well as planned future products the American company was selling or preparing to sell. We found numerous substantial IP problems which were serious enough that the Indian company decided not to proceed with the sale, saving our client perhaps millions of dollars in litigation costs and damages.
